These guidelines help keep NexusVM reliable, secure, and transparent for every builder.

1. Definitions

  • "We," "Us," "Our," or "NexusVM" refers to NexusVM and its affiliates, employees, agents, and contractors.
  • "You," "Your," or "User" refers to the individual or entity accessing or using our services.
  • "Services" refers to all products, services, software, websites, and platforms provided by NexusVM, including but not limited to hosting, cloud infrastructure, and related services.
  • "Content" refers to any data, information, files, software, or materials uploaded, transmitted, or stored through our services.
  • "Account" refers to your registered user account with NexusVM.
  • "Invoice" refers to a billing statement for services provided by NexusVM.

2. General Overview

These Terms of Service govern your use of NexusVM's infrastructure-as-a-service (IaaS), platform-as-a-service (PaaS), and related cloud solutions.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you do not agree with any part of these terms, you must discontinue use of our services immediately.

3. Eligibility & User Obligations

  • Age Requirement: You must be at least 13 years old to access our services. Users under 18 require consent from a parent or legal guardian.
  • Account Integrity: You agree to provide accurate registration details, keep them up to date, and protect the confidentiality of your credentials.
  • Prohibited Activities: Misuse, illegal actions, hacking, unauthorized automation, redistribution, resale, or attempts to compromise platform security are strictly forbidden.
  • Service Eligibility: To purchase specific plans, including Proxy Budget and Proxy Premium, you must be running at least one active backend server on our hosting. Customers who do not meet this requirement are not eligible to subscribe to or renew these plans.

4. Intellectual Property Rights

All trademarks, software, website design, and content connected to NexusVM are the exclusive property of NexusVM.

Any unauthorized use, reproduction, modification, or distribution of our intellectual property is prohibited.

5. Payments & Billing

We accept UPI, Visa, Mastercard, PayPal, and Bank Transfer for payments.

All transactions are securely processed through trusted third-party payment processors.

Pricing is subject to change at our discretion; any updates will be communicated whenever feasible.

Prices shown may exclude taxes. Customers are responsible for all applicable taxes, duties, or VAT/GST.

6. Subscriptions & Renewals

Subscription-based services automatically renew unless you cancel prior to the renewal date.

Cancellation requests take effect at the end of the current billing cycle.

Any adjustments to pricing or billing terms will be announced in advance.

7. Refund & Cancellation Policy

Refunds are evaluated in accordance with our Refund Policy. For complete refund terms, eligibility, and timelines, please review our Refund Policy.

Refunds are only available for Minecraft hosting and VPS/VDS/Dedicated Servers.

For VPS/VDS/Dedicated Servers, refunds are only allowed within 24 hours of purchase.

Services such as domain registrations are non-refundable.

Eligible services may receive refunds only when requested within the specified timeframe.

Chargebacks automatically void eligibility for refunds or credits.

8. Abuse Policy

You agree not to use our services for any illegal, harmful, or disruptive activity. This includes but is not limited to:

  • Hosting or distributing malware, phishing, or fraudulent content
  • Attacks such as DDoS or any network abuse
  • Harassment, threats, or abusive behavior toward our team or others
  • Unauthorized access to systems or data
  • Spamming or sending bulk unsolicited messages
  • Content involving exploitation, violence, or other banned material

8.1. Abuse Policy Enforcement

We may suspend or terminate services without prior notice if abuse is detected or suspected. We reserve the right to report illegal activity to appropriate authorities.

You are responsible for ensuring your users follow this policy. Repeated or severe violations may result in permanent bans and/or additional fees for damages.

9. Account Suspension & Termination

We may suspend or terminate services for violations of these Terms, non-payment, or abuse incidents.

Suspensions due to policy violations are not eligible for refunds.

9.1. Automatic Suspension & Data Deletion Timeline

  • Suspend server if invoice is overdue: Servers will be automatically suspended immediately (0 days) if the associated invoice becomes overdue.
  • Delete server if invoice is overdue: Servers will be automatically deleted if the invoice remains overdue for 14 days. This action also cancels the associated invoice.
  • Data Recovery: Once a server is deleted due to non-payment, all data is permanently removed and cannot be recovered. You are responsible for maintaining backups of your data.
  • Notification: We will attempt to notify you before suspension and deletion, but it is your responsibility to ensure your contact information is current and to monitor your account status.

11. Fair Use

  • For services described as "unlimited" or "unmetered," including but not limited to storage, bandwidth, or other tangible or intangible resources, clients are expected to adhere to a fair use standard. This ensures the continuity and quality of service for all clients. We reserve the right to enforce reasonable usage limits where necessary to maintain service integrity.
  • We reserve the right, at our sole discretion, to determine whether a client has violated the fair use policy. In the event of such a determination, the company may terminate the client's services immediately and without prior notice.
  • We maintain a fair use threshold, whereby no client shall utilize more than 10% of overall system resources or allocated network bandwidth. If a client exceeds 5% but remains below 10%, they will receive a written notice requesting immediate resolution. Failure to comply may result in further action as outlined in this agreement.
  • Clients must exercise reasonable judgment and discretion to ensure their usage complies with the fair use policy.

12. Abuse

  • Any applicable restrictions for the services outlined below will be specified at checkout. By proceeding with the purchase, you must indicate your acceptance of these restrictions by agreeing to an additional information section confirming your acknowledgment and agreement to the terms set forth.
  • Minecraft Services: Clients must adhere to the product descriptions, which are subject to periodic updates. It is the client's responsibility to review these descriptions regularly to ensure compliance with the relevant regulations. Failure to abide by the stated disclaimers and restrictions may result in the suspension of services, as outlined in our abuse and fair use policies.
  • VPS/Dedicated Services: VPS and dedicated services are allocated restricted resources. To ensure compliance and the continued provision of services, clients must adhere to acceptable and fair use policies.

13. Acceptable Use

  • Hacking activities, including unauthorized access to computers or networks, port scanning, stealth scanning, and phishing, are strictly prohibited.
  • Hosting files without proper purchase or any content that infringes on copyright or intellectual property rights is strictly prohibited.
  • Spamming, including bulk unsolicited emails or unauthorized commercial messages using our services, is strictly prohibited. Open SMTP connections for such purposes are also forbidden.
  • Uploading or linking to content that infringes on another individual's rights to privacy or publicity is strictly prohibited.
  • Distributing hate speech or any content that is obscene, abusive, libelous, or defamatory.
  • Hosting, storing, or distributing child pornography is strictly prohibited. Any discovered content will be reported to the appropriate law enforcement authorities immediately.
  • Child pornography, bestiality, hate speech, scam sites, phishing sites, and any other material deemed illegal under United States law are strictly prohibited.
  • Hosting, storing, or distributing pornographic material, including sites linking to adult content, is strictly prohibited. Additionally, our services may not be used for the propagation, distribution, storage, or handling of lewd, obscene, or satanic materials in any form.
  • Content Delivery Network (CDN) streaming on the company's servers or network.
  • Threats to perform, or the act of, attacks or doxing, including testing of our attack protection measures.
  • Hosting or selling account credentials obtained illegitimately or illegally is strictly prohibited. This includes, but is not limited to, using account generators or bots to scan or brute-force accounts.
  • The production, hosting, or sale of illegally or illegitimately obtained game codes, license codes, gift codes, hardware license codes, or software codes.

14. Payments, Cancellations & Chargebacks

  • Payments:
  • You must pay for services before each billing period.
  • Make sure your payment details are accurate.
  • Prices may change without notice.
  • If you have a card on file, we may automatically charge it before the due date.
  • Donation payments are final and non-refundable.
  • Cancellations:
  • Services continue to renew and bill until you formally request cancellation.
  • You are responsible for stopping any pre-approved payments.
  • Refunds apply only within the last 180 days, and payments older than 30 days are non-refundable.
  • Chargebacks:
  • Chargebacks are not allowed.
  • If you dispute a payment, we may suspend or terminate your service.
  • To restore service, you must repay the disputed amount plus any fees.
  • Fraudulent chargebacks may be reported to credit bureaus and fraud-prevention services.

15. Data Breaches

  • In the unlikely event of a data breach, we will take the following actions in compliance with applicable data protection regulations:
  • Affected parties will be notified within forty-eight (48) hours of us becoming aware of the breach.
  • We will disclose, to the extent known at the time, the nature of the breach, the categories of information believed to have been compromised, and the timeline of discovery.
  • Where applicable, we will notify relevant data controllers to facilitate a thorough investigation and ensure appropriate measures are taken in response to the breach.
  • Any services identified as compromised will be subject to immediate suspension to prevent further unauthorized access. Such services will remain suspended until the source of the breach has been thoroughly investigated and mitigated.
  • Our data protection officer will inform you and provide the next steps in accordance with the above protocol.

16. Service Usage & Compliance

You agree to comply with all applicable laws and regulations while using NexusVM services.

Unauthorized framing, linking, impersonation, or attempts to disrupt service integrity are not permitted.

Data mining, scraping, or automated access is restricted except where explicitly authorized.

17. User-Generated Content

You are solely responsible for any content uploaded, created, or distributed through our services.

NexusVM does not accept liability for user-generated content.

18. Privacy & Data Protection

User data may be stored and processed in secure facilities located in India and the United States.

Please review our Privacy Policy for detailed information on how we collect, use, and safeguard data. Our Privacy Policy is incorporated by reference into these Terms of Service.

19. Service Level Agreement (SLA)

We aim to provide reliable and uninterrupted service with a 99.9% uptime target each month. This uptime guarantee excludes:

  • Scheduled maintenance
  • Emergency maintenance required to protect service stability or security
  • Downtime caused by third-party providers, networks, datacenters, or upstream carriers
  • Factors outside our control, including user actions, hardware failures, malicious attacks, or force majeure events

19.1. SLA Service Credits

If downtime exceeds the guaranteed uptime outside of the exclusions above, we may provide service credits upon request. Service credits are not refunds and cannot be transferred, exchanged, or withdrawn.

We maintain reasonable performance, security, and support response standards. You are responsible for using our services in compliance with our policies and ensuring secure account access.

20. Backup & Data Integrity

Off-site backups are provided for select services as part of our resilience strategy.

You are responsible for downloading and safeguarding backups before canceling or terminating a service.

Data deleted after service termination cannot be recovered.

21. Limitation of Liability

NexusVM is not liable for data loss due to user negligence or actions by third parties.

We are not responsible for downtime caused by upstream network providers or other external factors.

In no event shall NexusVM be liable for indirect, incidental, or consequential damages.

21.1. Warranty Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. You acknowledge that there may be interruptions, errors, or security vulnerabilities in our services.

21.2. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that comes closest to the intent of the original provision.

22. Governing Law & Dispute Resolution

These terms are governed by the laws of India, with jurisdiction in Mumbai, India.

Arbitration will be the primary method for resolving disputes, unless mutually agreed otherwise.

23. Modifications to these Terms

NexusVM reserves the right to modify these Terms of Service at any time.

Significant changes will be communicated through appropriate channels. Continued use after updates signifies acceptance.
